Terms of Use
These terms, which also serve as the end-user licence agreement, are an agreement between you and Newgarden Solutions LLC ("we", "us") for the Multipoo app. By downloading or playing Multipoo you accept them. If you do not, please do not use the app.
1. Who can play
You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
2. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to install and play Multipoo on devices you own or control, for your own non-commercial entertainment, as permitted by the rules of the store you got it from. We keep all rights we do not expressly give you, including all rights in the game's code, art, sound and name.
You agree not to copy, modify, reverse-engineer, decompile or redistribute the app; not to cheat, exploit bugs, or use software that alters how the game works; and not to interfere with ads, purchases or the service's security.
3. Coins, gems and other in-game items
Coins, gems, upgrades and looks ("virtual items") are part of the licence to play. They are not real money or property, have no cash value, cannot be exchanged for money or transferred to anyone, and can only be used in the game. We may rebalance their prices and effects to keep the game fair and fun.
Virtual items are stored with your game progress. If you use Delete data, they are erased and cannot be recovered. Remove Ads is tied to your App Store or Google Play account and can be restored from the shop.
4. Purchases
Purchases are made through the App Store or Google Play and are subject to their terms, including their refund policies. Except where the law or the store's policy says otherwise, purchases are final. If a purchase does not arrive, try Restore in the shop and then contact us.
5. Ads
Multipoo is free and shows ads, including optional ads you can watch for a reward. Rewards are granted only when the ad network confirms the ad was watched. How ads use your information is explained in the Privacy Policy.
6. Updates and availability
We may update the game, change or remove features, or stop offering it. Some features, such as the cloud copy of your progress, ads and purchases, need an internet connection and third-party services that may not always be available.
7. Ending the licence
You can stop playing and delete the app at any time. We may end your licence if you break these terms. When it ends, you must stop using the app, and any virtual items you hold are lost.
8. No warranty
To the extent the law allows, Multipoo is provided "as is" and "as available", without warranties of any kind, including that it will be uninterrupted or free of errors.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost data or virtual items, arising from your use of the app. Our total liability for any claim is limited to the amount you paid for the app and in-app purchases in the 12 months before the claim.
Nothing in these terms limits rights you have as a consumer under the mandatory laws of the country where you live, or liability that cannot be limited by law.
10. Apple App Store
If you downloaded Multipoo from the Apple App Store:
- These terms are between you and us, not Apple. Apple is not responsible for the app or its content.
- The licence is limited to Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it does not comply with legal or regulatory requirements, and consumer protection or privacy claims.
- We, not Apple, are responsible for investigating and defending any claim that the app infringes someone's intellectual property.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Google Play
If you downloaded Multipoo from Google Play, the Google Play Terms of Service also apply. Google is not responsible for the app.
12. Changes to these terms
We may update these terms. The new version will be posted here with a new effective date, and continuing to play after that means you accept it. If a change is significant, we will say so in the game.
